The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements:
“Client“, “User”, “You” and “Your” refers to you, the person accessing this website or app and accepting the Company’s terms and conditions.
”The Company”, “Ourselves”, “We” and “Us“, refers to eConnect Japan Inc.
“Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.
All terms are determined between the users of the service and eConnect Japan Inc.
Agreement with the Terms of Service
Users are required to use the Services in accordance with rules of the Terms provided by eConnect Japan Inc. Without valid and irrevocable agreement to the Terms, the Users cannot use the Services. By using the Services, it will be inferred that the User has given valid and irrevocable consent to the Terms.
eConnect Japan Inc. does not collect personally identifying information with the sole exception of your specific knowledge and consent thereof. All information is stored in password protected directories and publicly inaccessible databases.
eConnect Japan Inc. does not sell nor distribute email addresses and/or other personally identifying information to third parties without your explicit permission, or use it for unapproved commercial purposes.
The company can collect data and use information for delivery and order information purposes and that of demographic data and identification of the users interests to continually improve our services for users.
Provision of the Services
The company can limit the provision of the Services to Users who fulfill the requirements deemed necessary by the company for the use of the Services, such as membership registration, age and identity verification.
Excess Data Usage
The network provider shall have the right to reduce and restrict the data access speed (upload and download) for customers who have used an excessive amount of data in a short period of time, which can adversely affect the network quality & deteriorate surfing experience for majority of the users in the shared network.
The user can make top ups at any given time up until 3 days after your plan has finished. After the user pays the corresponding amount for the top up, the company will issue an extension of data allowance within 1 minute after the payment is made.
Software and Updates
The download and use of our software and Apps is a direct agreement by the user to our terms and conditions. And the user agrees that the software may download and install upgrades, updates, and additional features from us in order to improve, enhance, and develop the software.
The company does not guarantee a stable internet speed, but shall state the average actual uplink and downlink speeds. The company is not liable in the event that the stated speed is lower than the actual speed due to but not limited to bad weather conditions, area not covered by service, and user traffic at a given time.
Use of Equipment and Products
All products must be used for legitimate and legal purposes. We will terminate the contract if the customer fails to do so.
We require you to exercise reasonable care in the use of our equipment, and handle all the equipment in accordance with the instruction we provide. Furthermore, you agree that you will not make any modifications, repaires or damage to all the equipment and that you are fully responsible and compensate if any of those is done.
We accept cancellation of the order at any time. However, the ammount that we refund depends on how early the customer cancel the order.
Should you need to cancel your order, please send us an email with your order information.
- 1 week before the pickup date or earlier: Full Refund
- From 6 days to 4 days before the pickup date: 50% Refund
- Less than 4 days before the pickup date or later: No Refund
We consider the time when we received cancelation request via email as the accepting time. Local time applies here. Refund will be issued within 3 days from the day we receive the cancelation request via email.
In the event that our sim does not work with your phone due to incompatibility or damage, we can give you any of the following options:
- Upgrade to any of our Pocket WiFi Plans for the price difference
- Pocket WiFi Device(without sim) for you to insert the SIM and use internet through it
- Full Refund
Violation of Terms
In the case where a User has been deemed to be using the Services in violation of the Terms, the Company will take measures judged by the Company to be necessary and appropriate. However, the Company does not guarantee to Users and third parties that Users and others will not violate the Terms. In addition, the Company does not bear the obligation to prevent or correct such violations for Users or third parties. The company can change either all or part of the Services, or suspend the provision of the Services without prior notification to the Users, in cases where it has been deemed necessary by the Company.
Although we do our best to serve you as best and as accurate as we can, eConnect Japan Inc. shall not be held liable in the event that we distribute inaccurate information which includes but not limited to: Data Usage, Setup Instructions, and FAQ’s.
The Company does not guarantee that there are no practical or legal flaws (including but not limited to faults in safety, reliability, accuracy, completeness, validity, the compatibility with specific purposes, security etc., errors and bugs, and infringement of rights) in the Service (including the Content). The Company does not bear an obligation to remove such flaws in providing the Services.
Applicable Law and Jurisdiction
The applicable law is Japanese law. For any disputes that occur between the Users and the Company related to or caused by the Services, the Kobe District Court or the Kobe Summary Court will be exclusive agreement jurisdictional court for the first hearing. The ruling from such jurisdictional courts will be enforceable in the court of any country.
